Driftwood Adventure Terms and Conditions

Welcome to Driftwood Adventure, an outdoor adventure company specialising in Kayaking, Stand-Up Paddleboarding (SUP), Canoeing, Rock Climbing and other related outdoor pursuits. These terms and conditions ("Agreement") govern your use of our services, including participation in our outdoor activities. By accessing or using our services, you agree to be bound by these terms and conditions. Please read this agreement carefully before signing and using our services.

Agreement Acceptance

1.1 By accessing or using our services, you affirm that you are of legal age to enter into this agreement, or you have obtained the necessary consent from a parent or legal guardian. If you do not agree to these terms and conditions, you must not use our services.

Safety and Assumption of Risk

2.1 All courses will be conducted in accordance with Driftwood Adventure operating procedures for outdoor activities. You must follow the instructions and safety guidelines provided by our guides or instructors.

2.2 Outdoor activities involve inherent risks, including but not limited to physical exertion, exposure to natural elements, accidents, injury, or even death. You acknowledge and assume these risks voluntarily.

2.2a For example, if you’re taking part in a water sport activity you may get wet and cold, as a mountain biker you may fall off. Minor cuts and bruises are not uncommon. You will also be out in the changeable Scottish weather.

2.3 You are responsible for ensuring that you have the necessary physical fitness and motivated ability required for participating in the chosen activity. If there is doubt about your ability to participate due to a health condition or injury, please check with your doctor if it is safe to do so.

2.3a You will be encouraged to participate fully in the course, but the degree of challenge is yours to choose. You will be expected, however, to comply stringently with our health and safety guidelines and procedures.

2.4 Please ensure that any medical condition(s) are made aware to staff prior and is stated on the booking form. It is your responsibility to inform us of any medical conditions, physical limitations, allergies, or other factors that may affect your participation in our activities. We reserve the right to deny access to any participant who we believe may pose a risk to themselves or others.

2.5 All Courses are run by competent and qualified staff to standards approved by the appropriate National Governing Bodies. Courses are designed to provide safe, challenging and enjoyable learning. All technical equipment is provided.

2.6 Our instructors are first aid trained with a minimum 2-day outdoor first aid course. However, please be aware that medical facilities may not be readily available on location during the course or activity.

2.7 Driftwood Adventure carries Public Liability and Professional Indemnity Insurance for all activities, however, we do not provide personal accident or belongings insurance. 

2.8 Participants and/or groups should arrange their own insurance as necessary.

2.11 Covid-19 disclaimer. By signing these terms and conditions you confirm that within the last 14 days you and your immediate household have not been infected or shown symptoms of Covid-19.

Bookings and Cancellations

3.1 To participate, you must make a booking through our website, by email, by phone or through the use of authorised agents. The booking is subject to availability and our confirmation. Your course and/or activities will be confirmed when we receive your booking form.

3.2 A non-refundable deposit or full payment may be required at the time of booking. The remaining balance must be paid before the activity commences unless otherwise specified.

3.3 When notified 14 days before the start date of an activity where there is a change in numbers attending, will have the deposit amount amended with the outstanding balance and no loss of deposit. Driftwood Adventure reserves the right to change this policy without notice for any reason.

3.4 If you wish to cancel your activity booking and request a refund at least 48 hours prior to the scheduled start time, you are eligible for a 50% refund of monies paid. Cancellations made within 24 hours of the scheduled start time are not eligible for refunds. This policy ensures that our team has appropriate time to make necessary arrangements and accommodate other customers.

It is your responsibility to review and understand the specific cancellation policy applicable to your booking. If you are unable to attend your course please contact us as soon as possible. We will try our best to postpone or re-schedule however in the event that this is not possible, any monies paid are non-refundable.

3.5 We recommend that you take out cancellation and curtailment insurance.

3.6 Whilst every attempt is made to ensure that courses run, in certain instances we may need to cancel courses due to dangerous or unsuitable conditions. We will endeavour to give as much notice as is practically possible. 

3.7 Driftwood Adventure staff reserve the right to cancel or modify any course in circumstances which render it necessary. Staff will give as much notice as possible and, in the event of cancellation, try to arrange alternative dates and times. Any course fees paid will be refunded if alternative arrangements cannot be made.

Liability and Release

4.1 You acknowledge that outdoor activities involve risks, and you agree to release, indemnify, and hold harmless Driftwood Adventure, its owners, employees, guides, instructors, agents, and affiliates from any and all claims, liabilities, damages, or losses arising from your participation in our activities, except in cases of gross negligence or willful misconduct.

4.2 You agree to assume full responsibility for any loss, damage, injury, or death resulting from your own actions, negligence, or failure to follow instructions provided by our guides or instructors.

Equipment and Hires

5.1 If you hire equipment from us, you are responsible for the safe and proper use of the equipment. Any damage or loss to the equipment, beyond normal wear and tear, will be your responsibility and will result in additional charges.

5.2 We reserve the right to refuse the hire of equipment to any participant who we believe may misuse or mishandle the equipment, or who fails to meet the necessary requirements or safety standards.

Voucher Terms and Conditions

6.1 Driftwood Adventure gift vouchers are valid for 18 months from the date of issue.

6.2 Gift vouchers cannot be redeemed for cash, however, they can be used as part payment for more expensive trips or courses.

6.3 Gift vouchers can only be used once.

6.4 Booking the activity requires the bearer to contact us by phone or email, quoting the voucher reference number and completing the booking process.

6.5 Booking is subject to availability. The paddle-sports season typically runs from March to October. Please book early in the season to avoid disappointment

6.6 There is no refund, postponement or voucher extension for a cancelled booking unless Driftwood Adventure has cancelled the activity session.

6.7 Driftwood Adventure Ltd reserves the right to change the location of the activity booked subject to environmental conditions and or safety.

Intellectual Property

7.1 All intellectual property rights related to our services, including but not limited to trademarks, logos, content, and photographs, are owned by Driftwood Adventure. You agree not to use, copy, or distribute any of our intellectual property without our prior written consent.

Protecting Your Information

8.1 We will not share information with other companies or third parties. If consent is not given to store your information, we will destroy the information when it is no longer required i.e. after your course.

8.1a If you wish to see the information that is stored about you or you wish this information to be safely destroyed, please contact us by email.

Governing Law and Jurisdiction

9.1 This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Driftwood Adventure operates.

9.2 Any dispute arising out of or relating to this agreement shall be subject to the exclusive jurisdiction of the courts in the aforementioned jurisdiction.

Modification and Termination

10.1 Driftwood Adventure reserves the right to modify or amend these terms and conditions at any time without prior notice. Any changes will be effective upon posting the revised agreement on our website, or upon your receiving and signing. It is your responsibility to review these terms and conditions periodically and/or upon receiving them.

10.2 We may terminate or suspend your access to our services at any time, with or without cause or notice, including in case of violation of this agreement.

Severability

11.1 If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
